If someone owes you money but doesn't want to pay, an order for payment (OAPO) can be a quick and effective legal solution. But how exactly does the payment order procedure work, how much does it cost and what steps do you have to go through? In this article, we have gathered all the important information to help you navigate the process.

What is an order for payment?

An order for payment is a formal, legal instrument that can be initiated before a notary to recover debts for amounts up to HUF 30 million. The procedure is quick and relatively simple, as it does not require court proceedings.

How to start an order for payment?

The order for payment can be initiated online through the Hungarian National Chamber of Notaries (MOKK). The procedure can be initiated with documents proving the existence of the debt (e.g. contract, invoice). The online payment order form helps to speed up the process.

How much does an order for payment cost?

What happens after the order for payment is issued?

  1. The notary issues the order for payment, which the debtor receives in the form of a formal notification.
  2. The debtor has 15 days to respond. If no objections are raised, the order becomes final.
  3. If the debtor does not pay, enforcement proceedings can be launched against him.
  4. If the debtor objects, the case can turn into litigation.

What happens if the debtor does not pay?

If the order for payment becomes enforceable but the debtor still fails to pay, enforcement can be started. In the course of enforcement, the debt may be deducted from the debtor's bank account, salary or property may be seized.
